What is Cal. Civ. Code § 1954.07?
Cal. Civ. Code § 1954.07 "Positive Rental Payment Information Reporting" (previously designated as AB 2747 in its bill form) is a California law that went into effect on 1/1/2025. The law requires property owners and operators to offer their residents the option of having positive rental payment information reported to at least one nationwide consumer reporting agency (“CRA”).
Who is Affected?
Cal. Civ. Code § 1954.07 generally applies to California landlords with rental buildings that contain more than 15 units.

What are the Requirements?
All Roommates Must be Included
All residents on the lease must receive the option to have their rental payment information reported to a CRA.

Reporting Must be Optional
It must be clearly explained to the resident that rental reporting to a CRA is optional.

Clearly State the Name of the CRA
The resident must be informed which CRAs will receive the rental payment reports.

Opt-in at Anytime
Residents are required to have the option to opt-in at any time throughout their lease.

Six Month Reporting Bar
If a resident opts out of rent reporting, they cannot opt back in for at least 6 months from the requested opt-out.

No Markups on Rent Reporting Service Fees
The rent reporting service fee to residents must not exceed the lesser of 1) The actual cost to the landlord to provide the service or 2) $10 per month.

When Does Cal. Civ. Code § 1954.07 Go Into Effect?
New Leases Entered Into On or After April 1, 2025
Offer must be made at the time of the lease agreement
Leases that are Outstanding as of January 1st, 2025
Offer must be made by April 1, 2025
Ongoing Rent Reporting Requirements after Initial lease
Property Owners and operators must offer rent reporting at least once a year
