Foxen is sensitive to your privacy and understands its importance. Foxen is therefore committed to transparency with respect to what information is collected, how that information is used, and what options you have regarding the collection and use of this information.   

What Information Does Foxen Collect and Why? 

The information that Foxen collects depends on the service being provided and on what you do when you visit the Website.  For all visitors to the Website, including those who visit the homepage, we may collect and store non-personally identifiable information. This information may include the name of the domain from which you accessed the internet, the date and time which you accessed the Website and the internet address (URL) of the website from which you linked directly to the Website. We use this information to measure the number of visitors to the Website, to help make the Website more useful to visitors, to help diagnose problems, and to administer the Website. If you enroll in one of Foxen’s services, such as Foxen’s credit technology solution that securely and accurately reports your rent payment history to credit reporting agencies, Foxen will need to collect additional PII, such as your name, address, phone number, email address, date of birth and rent payment history.  This PII is largely gathered through Foxen’s partnership with your landlord and through integration with your landlord’s property management software.         

“Cookies” are files or pieces of information sent to your browser when you visit a website. 

  • Most browsers are initially set to accept cookies. If you prefer, you can set your browser to refuse cookies or to alert you when cookies are being used. 
  • Persistent cookies are stored on the hard drive of your computer and remain there until they expire or you delete them. We may use them to improve your experience on the Website (for example, by remembering what pages you viewed on a previous visit). 
  • Non-persistent cookies are used during a particular session, but are not stored on your computer’s hard drive when the session is over. Foxen uses your PII to provide the service you are enrolled in and to improve your Website user experience.  Foxen may also collect and use your PII to respond to questions that you may have and provide customer support; communicate with you; ensure appropriate and authorized use of Foxen’s services; provide notice of new or modified services being offered by Foxen; and perform tracking and data analysis.  Additionally, Foxen may transmit your PII to credit reporting agencies, and use your PII to investigate and/or resolve any disputes you may have, including the transmission of inaccurate rent payment history to credit reporting agencies.   

How Does Foxen Use Your PII? 

Foxen will never rent or sell your PII to unaffiliated third parties. As a function of the service being provided to you by Foxen, Foxen may transmit your PII to third parties such as: credit reporting agencies, financial institutions, property management software companies, payment processors, Foxen affiliates, and service providers that perform services on our behalf (such as credit score user interfaces, software formatting companies, data storage companies, and data transmission companies).     

Foxen may store your information in locations outside the direct control of Foxen (for example, on servers or databases co-located with hosting providers). Your PII may be stored and processed in the United States, Europe, or any other country in which Foxen or its subsidiaries, affiliates or service providers maintain facilities. 

Foxen may employ other companies and individuals to perform functions on our behalf, including, but not limited to, hosting our web servers, analyzing data, providing marketing assistance, and providing customer service. These companies and individuals may have access to your PII solely for the purpose and to the extent necessary to perform their functions. 

Foxen may disclose any information we possess in response to subpoenas, court orders or legal requirements valid on their face, and such information may be used by the receiving party to determine your identity, your web usage, online behavior, or other things about you. Foxen generally does not inform users of such requests for information, although Foxen may, in its sole discretion, decide to do so in some cases. 

Please note that regardless of the nature of information and the way it is collected, you have no privacy in information which: 

  1. Foxen can demonstrate was known to it prior to receiving it from you; 
  2. becomes publicly available other than by violation of this Policy; 
  3. is determined by Foxen to be necessary to enforce the Terms of Use of the Website or to protect other rights of Foxen; 
  4. is determined by Foxen, a court, law enforcement officials or other authority to be necessary to protect the safety of the members of the public and users of the Website; or 
  5. becomes available to Foxen on a non-confidential basis from a source other than you and which source is legally entitled to disclose it. 

Unauthorized entry or use of the Website, hardware or software failure and other factors beyond Foxen’s control may compromise the security of the information collected at any time. 

In the event of a Foxen company sale, merger, acquisition, reorganization, liquidation, divestiture or other capital related transaction, the user data gathered by Foxen may be part of the assets transferred or shared in connection with due diligence for any such transaction. Any acquirer or successor company may continue to use the data we collect from you as described in this notice.

Retention of Your Information 

Foxen may keep your account information, like your name, address, and email address, for as long as your account is in existence because we need it to operate your account. When you are enrolled in Foxen’s services, we keep information about you and your use of the service for as long as necessary for our legitimate business interests.  From time to time, we may encounter new, unanticipated uses for information not previously disclosed by this Policy. Foxen reserves the right, in its sole discretion, to update and revise this Policy. You are encouraged to review this policy frequently for any changes.  Additionally, Foxen is required to adhere to certain credit reporting laws and data retention requirements; as such, retention of your data may continue beyond the date that you cancel the services you are enrolled in.  This may prevent Foxen from deleting your account information upon notification of service termination because rental payment reporting creates an established trade-line, which may result in continued reporting to credit agencies.  

Security of Your Information 

Foxen is dedicated to keeping your information safe and secure.  We use a combination of technical, administrative, and physical controls to protect the confidentiality, integrity, and availability of your information. This includes using transport layer security to encrypt data transmission and advanced encryption standards to encrypt data storage.  Note, however, that no method of transmitting or storing data is completely secure despite our best efforts.

Policies for Minors 

This Website and the services offered by Foxen are directed toward adults. If you are under the age of 16, you must obtain the authorization of a responsible adult (parent or guardian) before using Foxen's services. We will not knowingly collect or use any personal information from any children under the age of 16. If we become aware that we have collected any personal information from children under 16 we will promptly remove such information from our systems
